Diane Swierczynski joined Clark, Hunt & Embry as a senior litigator in 1998. Ms. Swierczynski graduated from Mount Holyoke College and Suffolk University Law School.  Since that time, she has worked primarily in insurance defense litigation. 

Ms. Swierczynski started her litigation career at Badger, Sullivan, Kelley & Cole, a  Boston firm which included a number of self-insured manufacturers in its client base.  In 1988, she went to Linehan, Gallagher & Mahoney, also in Boston.  While at Linehan, Gallagher & Mahoney, Ms. Swierczynski was selected to participate in Travelers Insurance Co.’s Trial Advocacy Program.

In 1993, Ms. Swierczynski founded Swierczynski Associates, heading the tort litigation for the Premier Insurance Company of Massachusetts, a Travelers subsidiary writing automobile and homeowners coverage.  As founder of one of the original field litigation offices for Premier, Ms. Swierczynski helped create Premier’s staff counsel operation. 

In addition to numerous jury trials, Ms. Swierczynski has also handled several cases in front of the Massachusetts Appeals Court and the Supreme Judicial Court, including MacDonald v. Lavery, 27 Mass. App. Ct. 1108, an oft-cited case in the area of intentional versus negligent torts.  Together with William Ahern, a partner in the firm, Ms. Swierczynski prevailed in Rhodes v. Beacon Sales, 416 Mass. 14, a seminal case which has resulted in tremendous subrogation recoveries for insurers in workers compensation third party actions

Since joining Clark, Hunt & Embry, Ms. Swierczynski has focused on general liability and product liability litigation, as well as construction accidents and construction defect litigation.  Ms. Swierczynski has also acted as local counsel for a national Protestant denomination, handling sexual abuse claims and employment matters.  Ms. Swierczynski has also served as an instructor for the National Institute of Trial Advocacy.  Ms. Swierczynski is admitted to practice in the Commonwealth of Massachusetts and the State of Rhode Island.
