Diane Swierczynski joined Clark, Hunt, Ahern & Embry as a senior litigator in 1998. She has worked primarily in insurance defense litigation since she was admitted to practice in 1985. Ms. Swierczynski has earned the coveted AV peer rating administered by Martindale-Hubbell.
In addition to numerous jury trials, Ms. Swierczynski has also handled several cases before the Massachusetts Supreme Judicial Court and the Appeals Court, including MacDonald v. Lavery, 27 Mass. App. Ct. 1108, an oft-cited case in the area of intentional versus negligent torts. Together with William Ahern, Ms. Swierczynski prevailed in Rhodes v. Beacon Sales.
Since joining Clark, Hunt, Ahern & Embry, Ms. Swierczynski has focused on catastrophic general liability and product liability litigation, as well as subrogation, construction and auto accidents. Ms. Swierczynski has also acted as local counsel for a national Protestant denomination, handling sexual abuse claims and employment matters, including the seminal case, which established that congregational churches are entitled to the same legal protections as hierarchal churches.
Ms. Swierczynski has been active in National Institute of Trial Advocacy programs, both as a participant and as instructor. Ms. Swierczynski is admitted to practice in the Commonwealth of Massachusetts and the State of Rhode Island.
